Ed Sheeran has just won an important court case against whether he plagiarised another artist’s track for his hit single “Shape Of You”.
The high-stakes dispute centered on a demo version of the song that writer opposition from Universal Music Group (UMG) and Sony/ATV owner Bertelsmann AG before Stream operators Spotify Technology S. The similarities between “Oh I” and “Why,” which are phrases from two different songs by Sami Switch (a grime artist performing under the name of Shape), have been pointed out in court proceedings against Ed Sheeran. The singer’s co-writers asked for an immunity deal so that none would face litigation; however, he denied any wrongdoing despite being accused of nearly identical sounding hooks being used on several tracks including ‘Shape Of You’.
In a shocking turn of events, the court dismissed Chokri’s counterclaim and granted a declaration to Sheeran and his co-writers that they had not infringed on any copyrights. The damages are expected to cost between £3 million for both parties!
He added: “As for Mr. Sheeran, the justification for declaratory relief was only increased by his admitted habit of copying and concealing other songwriters’ work.”
He said that he had been trying to clear his name and denied using litigation as a tactic for intimidating Chokri or O’Donoghue into giving up their dispute over the copyright.
The superstar frequently burst into song and hummed a tune from Blackstreet’s No Diggity, to illustrate how common the melody that Shape of You uses is.
He said the new song uses an “utterly commonplace” minor pentatonic pattern.
